Trooper saw client doing 80 mph in 55 zone and swerving from lane to lane. She first said she had 2 beers then admitted to 4. At jury trial, I emphasized how quickly she pulled over completely into breakdown lane, had no dificulty finding and delivering her license and registration and no difficulty exiting car and walking. I also stressed the field tests were done on the side of Route 3 at 1 am in 35 degree weather. Jury found her not guilty in under 30 minutes.

 Lowel District Court 6-26-19

Client smelled of alcohol, had glassy bloodshot eyes and admitted drinking 4 beers an hour ago. He was shaking badly during the sobriety tests and as a result was arrested. He failed both breath tests over limit at .09 and .10 but could not accept a CWOF due to his job so we fought. On the Motions date, the cops were not summonsed so I asked the Judge to mark the Docket "No further continuances." On the 2nd Motions date, the breathalyzer operator could not attend and the DA asked for yet a third date. I argued vigorously against giving the Commonwealth 3 bites at the apple and the second judge agreed. Case dismissed.

Lowell District Court

Result: No 2 year license loss or "ignition interlock device" required.

Facing his 2nd offense, client was stopped at a drunk driving road block and registered an over limit.16 Breathalyzer –twice the legal limit. At my Motion to Suppress, I argued that the roadblock did not comply with the very strict guidelines set up by the Supreme Judicial Court for the operation of roadblocks. The Judge agreed and threw the case out of Court.

I called and spoke to 3 DWI Lawyers recommended by the Massachusetts Bar Lawyer Referral Service and didn’t like any of them. I then called 2 additional lawyers I found on the internet and didn’t like them either. They all seemed incompetent or interested only in how fast I could send them money. "My prior OUI was 20 years previously but it was still my 2nd offense. Under the new law, I was entitled to be treated as a first offender once again. The Judge had evidently not heard of the new law and wasn't willing to do this. Joe reached into his briefcase and handed the Judge a copy of the new law and a recent case directly on point.
