At my jury trial, two cops testified that I had a strong odor of alcohol, slurred speech, and glassy bloodshot eyes. The arresting officer said I was "swaying in my lane" for over a mile but as, Joe dramatically pointed out in Court, she hadn't written that in her report. He then demonstrated the field sobriety tests in front of the jury box to show how hard they are and how well I had performed at 2 AM. He took care of everything from soup to nuts. After the Not Guilty verdict, he even was able to convince the Judge to restore my license immediately.

JOE BEAT JAIL FOR ME IN 2 COURTS IN 1 DAY! (DESPITE A .28 FAILED BREATH TEST) |

I was still on Probation for OUI-1st in Salem when I was arrested for OUI 2nd Offense in Ipswich and registered an over limit .28. My Salem Probation Officer issued a Warrant for my arrest and asked that I be placed into custody when I got to Newburyport. The DA in Newburyport was asking for jail also. Joe managed to talk the judge out of having me taken into custody AND of sending me to jail for my 2nd offense. Instead, the Judge actually released me into Joe's custody. Then when we went to Salem later that day, my Probation officer was asking for a one year jail sentence on my first offense. Joe convinced the Salem Judge not to do so and I went home that night instead of to jail. Joe is the most intimidating and confident lawyer I have ever encountered and I was blessed to have him on my side.

After our client was arrested for a second-offense drunk driving charge while riding his motorcycle, I convinced the jury that operating a two-wheel vehicle requires a finer sense of balance than operating a four-wheel automobile. Also, getting off of a motorcycle requires raising one leg up very high, which he was able to do without any difficulty or unsteadiness. Essentially, he performed a very difficult one leg stand test perfectly. When the cop testified he had him walk an imaginary line, I then asked the officer, "How wide was that imaginary line?" As he stammered trying to answer, the jury got the point. They deliberated only 15 minutes and then came back with a not guilty.

After I was stopped for speeding, cops said I failed the roadside tests and failed the breath test with twice the legal limit of .15. Joe argued that I committed no lanes violations, promptly signaled and safely pulled over when cops turned on their flashing lights. Then I showed no difficulty finding wallet and getting license or finding registration, and no trouble getting out of the car or walking. Jury came back with not guilty after only 10 minutes.

Charged with his 2nd offense, client was stopped for speeding 71 mph in a 45 zone and straddling the fog line. After failing 2 sobriety tests and admitting to 4 drinks, he made the above statement to the cop at the station after being arrested.
I got the cop to admit on the stand he waited in that area nightly because "he caught a lot of speeders on that stretch." Then I demonstrated the 2 sobriety tests in front of the jury, pointed out they were done at 1 AM on the fog line of a highway with CARS SPEEDING BY just 2-3 feet away.
(If convicted, my client would have lost his license for 2 years and his dream job as a cameraman at a top TV news station.) |
