At Joseph's trial, the officer testified he smelled of alcohol, had glassy eyes, showed unsteadiness on his feet and failed the field tests. At trial, I called his passenger. On the day of trial, I submitted a pretrial motion to exclude any testimony about the container because the police had not preserved it or brought it to court and the judge allowed my motion.
