Under-21 OUI Wins in Massachusetts

My 19-year-old client failed the breathalyzer test at the police station. I reviewed the booking video and discovered the test was not performed properly. After a motion to suppress hearing that lasted 4 hours, the judge agreed and threw out the breath test. On the day of trial, the DA realized he couldn't prove his case without it and dismissed the OUI charge against her.

The judge gave him a lecture about speeding but found him not guilty of drunk driving.

Worcester District Court
