Under-21 OUI Wins in Massachusetts

UNDER-21 OUI DISMISSED
DESPITE FAILED BREATH TEST

ALEX 516-582-8320

My 19-year-old client failed the breathalyzer test at the police station. I reviewed the booking video and discovered the test was not performed properly. After a motion to suppress hearing that lasted 4 hours, the judge agreed and threw out the breath test. On the day of trial, the DA realized he couldn't prove his case without it and dismissed the OUI charge against her.

See judge's order suppressing breath test and DA's motion dismissing OUI.

OUI-MARIJUANA
DISMISSED

ZACH 781-454-6884

My under-21 client was arrested after throwing a Hawaiian punch bottle out of his window. The officer smelled marijuana and then Zach admitted that he'd been smoking. He forced my client out of his car and made him do three field tests. He then arrested him for OUI-drugs marijuana. After several pretrial court dates and hearings, we scheduled the case for trial. On the day of trial, the district attorney approached me just as we were ready to be called. He then said they were dropping all of the charges.

100+ MILE PER HOUR
NOT GUILTY

A Massachusetts state trooper measured my under-21 client driving over 100 mph. After being pulled over, he told the officer he had just come from a bar and had three drinks within the past hour. The officer asked him to get out of the car and noted in his report that he was unsteady on his feet as he did so. He was also unsteady performing three field tests. He was argumentative and uncooperative as well. At our bench trial, I convinced the judge that the lateness of the hour—it was past 2 a.m.—as well as other factors explained his behavior and created the necessary reasonable doubt. The judge gave him a lecture about speeding but found him not guilty of drunk driving.

UNDER 21 3 YR. REFUSAL
SUSPENSION OVERTURNED

I was only 19 years old when I was arrested for my first DUI. I had no idea I would lose my license for three years just for refusing the breathalyzer. After calling this law firm, they told me there are only 15 calendar days after my arrest to fight this. They guided me through this process every step of the way at the registry and then they appealed it up to a judge in court. The judge then gave me my license back saving me three years without one.
