The trooper said I smelled of alcohol, had red, glassy, bloodshot eyes, and performed poorly on the field sobriety tests. Plus, he testified I didn't blow into the breath machine correctly and called it a refusal causing a three year license loss. At trial, Joe stressed to jury:
- it was 2:30 AM,
- there was no erratic driving as he followed me for one and a half miles,
- he said there was nothing abnormal with my fine motor skills, and
- he never noted that my speech was slurred in his 4 page report.
Jury verdict: Not guilty.
