Ed's Case

At Joseph's trial, the officer testified he smelled of alcohol, had glassy eyes, showed unsteadiness on his feet and failed the field tests. At trial, I called his passenger. She testified she felt completely comfortable with his driving and riding in the car with him. Jury acquitted him of all criminal charges avoiding a potential five-year license loss.

My client was facing multiple charges including an open container of alcohol. On the day of trial, I submitted a pretrial motion to exclude any testimony about the container because the police had not preserved it or brought it to court and the judge allowed my motion. As a result, the DA was unable to prove two other charges beyond all reasonable doubt. After the acquittals, the judge restored his right to drive in Massachusetts as well.
